Απαγόρευση του Playstation 3 στην Ευρώπη

Πριν από λίγες ημέρες, η LG κέρδισε την αγωγή απέναντι στη Sony. Το Playstation 3 απειλείται πλέον σοβαρά.

Οι τελωνειακοί υπάλληλοι της Ευρώπης έλαβαν εντολή να κατάσχουν οποιεσδήποτε αποστολές Playstation 3 εισέρχονται στην ήπειρό μας, μετά από την νικηφόρα διαμάχη σχετικά με τα δικαιώματα ευρεσιτεχνίας που κέρδισε η LG απέναντι στη Sony. Η Κορεάτικη εταιρεία, είχε καταθέσει ασφαλιστικά μέτρα προς την Sony με την κατηγορία ότι η τελευταία αντέγραψε την τεχνολογία της LG για την αναπαραγωγή των δίσκων Blu-ray. Tο δικαστήριο της Χάγης δικαίωσε πριν από λίγες ώρες την απόφασή της.

Η ποινή αυτή τελειώνει σε λίγες ημέρες, με την LG να μπορεί να καταθέσει πρόταση επέκτασης της ποινής και την Sony να μπορεί αντίστοιχα να καταθέσει έφεση για την ανάκλησή της. Η Sony εισάγει στην Ευρώπη περίπου 100.000 Playstation 3 ανά εβδομάδα, οπότε προς το παρόν υπάρχει απόθεμα με το οποίο οι καταναλωτές «την βγάζουν» για τουλάχιστον 2-3 εβδομάδες.

Οι δύο εταιρείες έχουν πολλά προηγούμενα, καθώς πέραν της παραπάνω υπόθεσης εκκρεμούν άλλες έξι, που έχουν επίσης να κάνουν με δικαιώματα κατοχύρωσης ευρεσιτεχνίας. Σε μία από τις άλλες υποθέσεις, η Sony επιχειρεί να διακόψει την κυκλοφορία των smartphones της LG στην Αμερική.

Προς το παρόν, έχει ήδη απαγορευθεί η είσοδος στην Ευρώπη για δεκάδες χιλιάδες Playstation 3. Μένει να δούμε ποια θα είναι η συνέχεια της δικαστικής διαμάχης, ενώ αξίζει να αναφέρουμε ότι η LG μπορεί να βάλει κι άλλο το μαχαίρι στο κόκαλο, ζητώντας από την Sony αποζημίωση για τα Playstation 3 που έχει πουλήσει έως τώρα, κάτι που σε περίπτωση δικαίωσης θα της αποφέρει αρκετά δισεκατομμύρια ευρώ.

Για το μεγάλο αυτό ζήτημα, οι δύο εταιρείες δεν έχουν δηλώσει ακόμη κάτι το επίσημο.

αλλα η αποφαση του δικαστηριου ειναι οτι η lg εχασε την δικη και πρεπει
να αποζημιωση την sony με το ποσο τον 130.000 για τα δικαστηκα εξοδα αν δεν το κανει εως μιας προκαθορισμενης ημερομηνιας τοτε καθε μερα που θα περναει η lg θα πρεπει να δινει σαν προστιμο επιπλεον 200.000 .
και βεβαια η κονσολες διοχετευοται αμεσα στην αγορα.

With LG seizing 300,000 PS3s and planning to seize another 180,000, demanding up to $350 million and a ban on PS3 sales in The Netherlands, today marked one of the most important court cases in Sony’s long history as a technology company. Thankfully, it now looks like Sony has won the first battle against LG, not only defeating the company, but receiving reimbursement.


Dutch site InsideGamer.nl reports that Sony has won the summary proceedings and that LG will be made to pay 130,000 for the cost of the court case and 200,000 every day until all the 300,000 PS3s are returned. This has been corroborated by Florian Mueller:

It’s definitely true that Sony won over LG, an independent source just confirmed it to me!

This only covers the seizure of the PS3s, so LG still could possibly win a case against Sony for patent infringements at a later date, with the company probably set to continue asking for $350 Million.

Moments ago, a court in The Netherlands ruled against LG in an ongoing patent battle against Sony. Freeing up PS3s in the country – and therefore Europe – the move was a major victory for the Japanese technology giant, but Sony are by no means in the clear, with LG still set to push for royalties that could be as high as $350 million. To find out what the case could mean, and just how close Sony were to losing, PlayStation LifeStyle talked to award winning intellectual property activist, author and FOSS Patents blogger Florian Mueller.


In a statement, Florian told us:

It was of the utmost importance for Sony to achieve this decision. Sony wants a comprehensive settlement of all patent disputes between the two companies and now it will be able to seek such a solution without being under pressure. I believe Sony is particularly interested in collecting royalties on LG’s smartphones.

As Florian had an inside source watching the court case we asked how close the verdict actually was, and whether it was a clear cut victory from the start, or whether Sony managed to pull a victory from the skin of their teeth. Mueller replied:

When the judge announced a recess, most people in the room thought he was going to return and uphold the order for the time being. This was a surprising turn of events in Sony’s favor.

We also asked if LG would continue to push for $350 million.

I’m sure their demands are the same, but they now have less leverage than before.

Florian also commented on whether the ruling boded well for Sony in future cases:

That depends on the details of the ruling, which I don’t know yet. If the court established some principles that will also be relevant to many other cases, then the answer is yes.

And if the fines placed on LG were reasonable:

Those fines are of a purely theoretical nature. I’m sure LG will comply with the ruling.

LG will likely continue to press Sony for financial reimbursement over the claimed patent infringements, but such rulings will be far more drawn out than the quick prejudgement case held today.
